RIGHT TO STAY

After you or your spouse have applied for divorce or when you and your cohabiting partner have separated a court can, at the request of one of you, decide who has the right to stay in your joint dwelling until implementation of the estate division. Whoever has the greatest need for the dwelling will be granted the right to stay. Whoever is not granted the right to stay must immediately move and does not have the right to enter the dwelling without the other spouse’s consent.
